Transition to amended Rules of Practice and Procedure May 1, 2026

The Tribunal is amending its Rules of Practice and Procedure effective May 1, 2026 [Amendment].

The Amendment changes the procedure for dismissal applications under s. 27(1) of the Human Rights Code under rule 19.

This practice direction addresses the transition to the new procedure set out in the Amendment.

Application of the Amendment

With the exception set out below, the Amendment applies to all complaints.

Rules 19(4) and (5) in the Amendment will apply only to those complaints where the Tribunal has not yet notified the parties of their disclosure requirements. Effective May 1, 2026:

  • under rule 19(4), when the Tribunal notifies the parties of their disclosure requirements, it will also set a deadline for filing a Form 7.5 – Request to File Dismissal Application; and
  • under rule 19(5), a respondent who wants to file a dismissal application must file a Form 7.5 – Request to File Dismissal Application within the deadline set by the Tribunal.

Procedure for complaints where Rules 19(4) and (5) in the Amendment do not apply

Where the Tribunal notified the parties before May 1, 2026 of their disclosure obligations and set a deadline for next steps under the Rules as amended on November 15, 2024, then the process is set out in the Case Path Pilot Practice Direction as amended May 1, 2026.

The Case Path Pilot Practice Direction amended May 1, 2026 will be withdrawn when the Tribunal has completed setting the case path for those complaints to which it applies.

Any other issues

Any other issues respecting transition to the amended Rules should be brought to the Registrar’s attention.
