Time limits to ask to apply to dismiss a complaint without a hearing

The Tribunal will set a deadline for a respondent to ask to file a dismissal application. Usually, this will be in the Tribunal’s letter setting deadlines for disclosure of documents.

After that deadline, rule 19(6) of the Tribunal’s Rules sets a 14 day deadline to ask to file a dismissal application based on new information or circumstances.

If the Tribunal agrees that you can apply to dismiss, it will give you a deadline.

Extending time to ask to apply to dismiss a complaint without a hearing

A respondent who needs to extend the time must notify the tribunal of the length of the extension requested and either that the other parties consent or the reasons for the request.
