  • Case Path Pilot – Extension and Review

    The Tribunal issued its Practice Direction initiating the Case Path Pilot [CPP] on May 6, 2022 and subsequently extended it pending the ongoing process review. The most recent extension expired on April 30, 2025.

    As of May 1, 2025, the Tribunal is extending the CPP until May 1, 2026 to coincide with its process review work.

    By way of background, the Tribunal’s process review is ongoing. Progress on the process review has been slower than anticipated as the Tribunal has worked to grow its resources and concentrate on its backlog strategy. However, the Tribunal has made progress in both areas over the 2024-25 fiscal year. Now that the Tribunal has stabilized, it will continue the process review in the coming months, turning its focus to considering the process for the Tribunal’s administration of its discretion under s. 27(1) of the Code.

    In March 2025, the Tribunal launched a survey on the CPP process and other process options, seeking feedback from participants about how to improve the Tribunal’s process. In the survey, the Tribunal sought feedback on the CPP process, as well as other process options, including reverting to the process before the May 2022 start of the CPP, a “simplified hearing” process, and a “summary hearing” process, explained in the survey. The Tribunal has begun its work of reviewing the survey responses, and considering next steps. It will take time to complete this work, giving rise to the extension of the CPP in the interim.
